Mr. Fredericks is a member of the Mandan, Hidatsa and Arikara Nation. He is a former partner
in the law firm of Fredericks, Peebles & Morgan LLP and established his own Firm on January 1, 2019. Fredericks has over 30 years of experience representing Native tribes, specializing in Federal Indian, Commercial, Energy, Tax and Business Law and Litigation. He has successfully represented Indian Tribes and entities before tribal, state, and federal courts and administrative bodies throughout the country. Mr. Fredericks has experience in a wide variety of areas including tribal sovereignty, treaty rights, taxation, housing, tribal government, economic development, energy and natural resource development.
Fredericks has represented Indian Tribes in matters related to the development of their natural resources, including oil and gas, coal and geothermal. As part of his work for the MHA Nation, Fredericks authored legal opinions regarding the ownership of the minerals under the Little
and Big Missouri Rivers within the Fort Berthold Indian Reservation, and helped negotiate
two major oil pipeline rights of way. Fredericks has represented Tribes in the negotiation of intergovernmental tax compacts with states, including the first fuel tax agreement in Nevada
and the current oil and gas tax agreement between the MHA Nation and North Dakota.
Mr. Fredericks is a graduate, with honors, of the University of Montana in 1984, and the University of Colorado, School of Law in 1987.

Mr. Breuer began his legal practice in 2012 and brings a wealth of experience in representing tribal governments and tribal businesses in contract negotiations, litigation, and administrative proceedings. Mr. Breuer has also served tribal governments as general counsel and can provide legal guidance on a range of topics from employment law to housing. If a Tribe requires updates to their codes, or entirely new statutes, Mr. Breuer has drafted codes ranging from marijuana taxation to air quality.
Tribal governance faces an ever-changing legal landscape and Mr. Breuer stand ready to assist his clients in navigating new federal regulations. Recently, Mr. Breuer assisted the Pyramid Lake Paiute Tribe Tax Department in creating and enforcing rules and regulations on the taxation of marijuana. As a result, Mr. Breuer is well-versed in the legal and administrative requirements for Tribes to undertake the cultivation, regulation, and taxation of marijuana and hemp.
Economic development requires significant investment in infrastructure, housing, and commercial property. Mr. Breuer has deep experience in the creation of procurement policies, the drafting of construction contracts, and the litigation of disputes arising from construction. With experience on construction projects ranging from $25,000 into the millions of dollars Mr. Breuer can provide legal services designed to fit your needs. If litigation is required, Mr. Breuer recently defeated a claim by a former contractor of the Fort Peck Housing Authority for payment upon non-existent or fraudulent contracts. (Gourneau v. FPHA, Appeal No. 666 (FPTCA 2015)).
Environmental laws and regulations have significant impact on the operations of tribal governments and tribal businesses. Mr. Breuer has significant experience with the Clean Air Act, the Clean Water Act, and a host of other environmental laws. Mr. Breuer can assist his clients with either obtaining or denying environmental permits. If a Tribe requires significant environmental code work Mr. Breuer has drafted both water quality codes and air quality codes.
